Paris Partner Kathie Claret authored an article for the September edition of Travel Law Quarterly on the competition and consumer fraud authorities, which have taken action within the French hotel industry to counter certain aggressive marketing policies and practices of online travel agent services. “[G]iven that the clauses and practices implemented by OTAs [online travel agencies], especially Expedia and Booking, are being carefully scrutinised, all OTAs should assess their market and legal positions if they wish to implement or retain parity and other restrictive clauses in their agreements,” Claret cautioned.
