Biography

Randy leads the Mass Tort & Product Liability Team and has over two decades of experience handling the defense of complex, high stakes, personal injury and wrongful death claims. His litigation and trial practice focuses on complex contested matters in the areas of product liability, toxic tort, class actions. Randy has first chair trial experience with personal injury and wrongful death cases as well as mass tort actions, multi-district litigation, and the representation of corporate clients defending against high stakes claims alleging serious personal injury or death in courts throughout the country. 

Randy has represented national pharmaceutical clients in mass tort defense including the coordination and management of hundreds of lawsuits. He has handled numerous fire and explosion matters, both lawsuits and pre-suit claims, and has developed a successful track record of getting these matters disposed of promptly and favorably for his clients. He has also represented clients from the aviation industry in lawsuits alleging personal injury or wrongful death claims involving aircrafts. Randy also has experience representing clients from the elevator and firearms industries in the defense of personal injury or wrongful death claims. These lawsuits almost always include complex, scientific defenses addressing both general and specific causation issues and include working with nationally recognized scientists and medical professionals. Randy has a keen ability to design arguments supported by complex, highly technical science and is especially adept at making these complex issues understandable to the judge and jury – a critical skill for any trial lawyer.

Randy’s intellectual property litigation experience focuses primarily on high stakes patent litigation. He also has experience with toxic tort cases and claims related to environmental contamination. His experience encompasses all aspects of the litigation process, including case strategy and management, pre-trial motion practice, depositions, hearings, settlement negotiations, and trial preparation. Randy has trial experience in state and federal courts throughout the country.

Experience

  • Key member of trial teams that won complete defense verdicts for client in jury trials in multiple states, including Missouri and Pennsylvania.
  • Obtained summary judgment in four multi-plaintiff lawsuits alleging property damage to several residences as a result of alleged environmental contamination. In granting summary judgment against Plaintiffs as to all claims and fully in favor of Defendants, the Court also ordered costs taxed to the Plaintiffs.
  • Obtained dismissal, with prejudice, for client in multi-plaintiff wrongful death and personal injury lawsuit. 
  • Obtained summary judgement for a pharmaceutical client in a medical device case in the Eastern District of Missouri which was then affirmed by the 8th Circuit Court of Appeals.
  • After a favorable settlement for his client in the underlying personal injury suit, was able to recover attorney’s fees and costs for that same client by obtaining summary judgment on the issue of contractual indemnification against a co-defendant.  High six figure attorney’s fees and cost awarded to his client as well as the summary judgment grant were then affirmed on appeal to the Missouri Court of Appeals, Eastern District. 
  • Co-tried a patent infringement suit which resulted in his client being awarded 7 figure damages award, attorney’s fees, and an on-going royalty stream for the remaining term of the patent at issue.
  • Obtained summary judgment for a defense client in a complex personal injury case alleging permanent neurological impairment as the result of medically diagnosed carbon monoxide poisoning in federal court, trial court’s summary judgment ruling was affirmed on appeal.
  • Co-tried and obtained a complete defense verdict in a week long jury trial alleging permanent injury on behalf of a national do-it-yourself truck rental client.
  • Co-tried and obtained a complete defense verdict in a failure to warn claim for a leading paint and covering products manufacturer.
  • Helped to manage hundreds of cases alleging personal injury, wrongful death, products liability, individual claims, multi-party claims, and class actions for a national pharmaceutical manufacturer who withdrew the product at issue from the world wide market and after a global settlement was reached helped to manage the administration of the settlement process throughout the country.
  • Was on a trial team that obtained a complete defense verdict for a national automobile manufacturer in a consumer class action in a notoriously plaintiff-friendly venue in state court in Southern Illinois.
