Sara Markert is a financial services attorney representing national banks, mortgage servicers, and other businesses in federal and state courts across the country in a wide variety of high exposure and complex claims. She is an experienced trial lawyer, having litigated cases in federal and state courts in California and New York at both the trial and appellate level. She has appeared and argued cases before the California Court of Appeals, the United States Court of Appeal for the Ninth Circuit, and the New York Appellate Division. 

Ms. Markert has experience representing financial institutions in litigation concerning federal regulation of the industry, including TCPA (“Telephone Consumer Protection Act”), FDCPA (“Fair Debt Collection Practices Act”), FCRA (“Fair Credit Reporting Act”), TILA (“Truth In Lending Act”), and RESPA (“Real Estate Settlement Procedures Act”), as well as state consumer protection statutes, including California Business and Professions Code Sections 17200 and 17500, and common law privacy and real estate claims. Ms. Markert also holds an active Real Estate Broker’s license issued by the State of California.

Ms. Markert is a member of the International Association of Privacy Professionals and holds a CIPP/US data privacy certification. To that end, she advise clients and drafts policies related to the California Consumer Privacy Act (CCPA) and Global Data Protection Act (GDPR). She also counsels corporate clients on Incident Response Management and breach tabletops.

Prior to joining the firm, Ms. Markert spent several years managing a significant litigation portfolio and providing corporate compliance strategy and advice in the law department of a publicly traded company. In this capacity, she managed a national financial services institution’s portfolios of consumer finance litigation and class actions. In her capacity as in-house litigator, Ms. Markert actively managed and participated in the conduct of several of the institution’s jury trials across the country. Ms. Markert also handled a variety of data and technology issues for the corporate legal department ranging from breach investigations to management of the eDiscovery and litigation hold processes. Ms. Markert’s extensive in-house experience, straightforward communication style, and intuitive courtroom skills, provide unique insight and litigation strategy for institutional defendants.
