At the end of January, the Paris Compliance Team, together with the Risk & Co group, won a French Anti-Corruption Agency (AFA) bid to advise it as a "Sapin II compliance audit expert."
The Paris Compliance Team, composed of Constantin Achillas, Joseph Smallhoover, Cécile Terret, David Père, Sarah Delon-Bouquet, François-Xavier Mirza, and Laure Gastineau, applied together with Risk & Co, a French strategic intelligence firm who is specialized in corporate due diligence.
Created in 2016 by the Sapin II law, the AFA’s mission is to make recommendations to private and public companies as well as administrations on the effectiveness of, and potential improvements to, their anti-corruption programs. The AFA also controls, as a preventive measure, the quality and effectiveness of the procedures implemented to fight against breaches of probity (measures referred to in Article 17 of the Sapin II Law). In case of non-compliance with the provisions of article 17 of the Sapin II law, the agency can issue warnings and impose sanctions. The AFA has been authorized to request support from third-party firms and appoint them as expert to assist in its controls of the application of Sapin II law within French groups headquartered in France and with subsidiaries abroad.
Only six consultancy firms, including BCLP, were selected by the AFA following the public bid to carry out compliance audits consisting in reviewing the legal aspects of the mandatory compliance program (code of conducts, risk mapping, ethic hotline, anti-corruption training, etc).
