BCLP Partner Andrey Spektor was quoted Jan. 5 by Law360 concerning the uphill battle Elizabeth Holmes faces in appealing her convictions for wire fraud, and the prospects for her co-defendant, Ramesh "Sunny" Balwani, who will be tried next.  Andrey, a former federal prosecutor, noted that Holmes’ trial could give Balwani an advantage by providing him with a “roadmap” of the government’s case. Andrey added that Balwani may also be encouraged that jurors in Holmes' case had focused on audio recordings of her speaking with investors in 2013 before reaching their verdict. That could benefit Balwani if there are no similar recordings of him.
