BCLP Partner Andrey Spektor was quoted Nov. 24 in The New York Times regarding Elizabeth Holmes’ strategy in testifying in her own defense at trial. This was the second time Andrey was quoted by The New York Times in one week. The article summarized Holmes’ apparent strategy in her risky move of taking the stand. Andrey observed that, “The whole ballgame comes down to knowledge and intent, and it’s the hardest thing for the prosecution to prove.” Andrey explained that the government’s best evidence about Holmes’ intent is circumstantial, coming from documents and the testimony of others. But she could testify directly about what she knew and intended, he said.
