BCLP Partner Ashley Ebersole has organized, and will serve as moderator of, the Oct. 12 webcast “The Intersection of Regulation, Investment, and Technology in the Crypto Universe.” The program will consist of a fireside chat between SEC Commissioner Hester Peirce and Ashley, followed by a panel discussion exploring open regulatory questions in the cryptocurrency and digital assets space.

Decentralized finance, or DeFi, adds the question of who to regulate, since the decentralized applications that define this space may lack a central authority to control them. Yet all of these financial technologies continue attracting massive funding from established actors and new entrants alike. The panel will discuss these technologies’ potential, as well as their potential for regulation.

Ashley is a former U.S. Securities and Exchange Commission (SEC) attorney whose practice focuses on regulatory and enforcement matters in the contexts of both crypto assets and traditional securities, corporate and fund formation work in the fintech space, and corporate internal investigations and white collar criminal defense. He has unique experience with the SEC’s digital asset regulatory and enforcement efforts, and provides counsel to all varieties of participants in that space. 

His broad experience at the SEC included lead roles in all aspects of SEC investigations and litigation that implicated all of the securities laws, and involved both domestic and international parties. He also was a longtime member of the SEC’s cross-division working groups with responsibility for shaping the agency’s response to emerging technologies, including the Distributed Ledger Technology Working Group since its inception, and the Dark Web Working Group. Through these affiliations, Ashley initiated and conducted some of the first investigations of securities law violations involving digital assets.

After joining Commissioner Peirce for the fireside chat, Ashley will co-moderate the panel with Ji Hun Kim, Associate General Counsel and Head of Regulatory Affairs at Gemini Trust. Other panelists will include Peirce; Gus Coldebella, Partner at True Ventures and former acting General Counsel at DHS, Mary Beth Buchanan, President and Global Chief Legal Officer at Merkle Science; and Kristin Smith, Executive Director of the Blockchain Association.
