BCLP Partner Andrey Spektor was quoted Dec. 6 by The Wall Street Journal concerning the sentencing of Theranos Inc. Ex-President Sunny Balwani. Judges are required by law to avoid unwarranted differences in sentences issued for similar crimes, Andrey, a former federal prosecutor, explained after noting that Balwani’s co-defendant, Elizabeth Holmes, had just been sentenced.  Andrey added that a large disparity in sentences could appear particularly unfair in a case like Theranos, where the defendants have very similar crimes, neither have a criminal history and neither cooperated with the government.
