The following list provides a representative sample of the depth, range, and diversity of the types of cases Bryan Cave has handled in this area:

National Hockey League Concussion Litigation

Bryan Cave is currently lead counsel for 30 of the United States and Canadian member-franchises of the National Hockey League in a pending multi-district class action litigation relating to concussions/head-injury claims. The NHL Litigation involves claims by current and former NHL players relating to injuries allegedly stemming from concussion and/or repetitive head trauma during their careers in the NHL, and includes a request to implement a medical monitoring program for all qualifying participants.

NCAA Representation

Bryan Cave has represented/currently represents the NCAA in:

  • Cunningham v. NCAA – Defended the NCAA against concussion litigation claims filed by James Cunningham who asserted that he suffered multiple concussions and/or head injuries during his time playing basketball at two NCAA member institutions and that, as a result, he was nearly completely debilitated
  • Washington v. NCAA – Defended the NCAA against claims relating to negligence filed by Miles Washington, a former University of New Mexico football player, who suffered a severe spinal cord injury during an intra-squad scrimmage for the New Mexico State football team when he was tackled by one of his teammates
  • Ploetz v. NCAA – Defended the NCAA against concussion litigation claims filed by the widow of former University of Texas football player Greg Ploetz

Representation of Physicians/Trainers in Alleged Football-Related Injuries

We have represented physicians and athletic trainers in litigation asserted by former football players in the NFL and its former European subsidiary. In these cases, the former players alleged that the physicians and trainers failed to properly diagnose the players’ head injuries and/or improperly allowed the players to return to play before they should have.

Non-Sports-Related Litigation Involving Alleged Concussion/Head-Injury

Bryan Cave has represented numerous clients across the country in negligence and product-liability cases involving claims for concussions and other traumatic brain injuries. Bryan Cave’s clients in these cases include automobile, airplane and bathroom and kitchen manufacturers, car/truck rental companies, as well as major department stores, and the claimants have included drivers, passengers, customers, parents and children. In many of these cases, the parties have engaged in extensive fact and expert discovery, to include engaging, preparing, deposing, and cross-examining neurologists. As part of this intense discovery, the Bryan Cave attorneys have analyzed and made use of the claimants’ medical records and histories, particularly with regard to prior head and brain injuries. As a result, Bryan Cave has obtained early dispositions in some cases and favorable settlements in others.
