Denver Associates Ivan London and Zachary Fitzgerald authored an article published March 5 by Law360 concerning the controversial practice of “force-pooling” oil and gas interests pursuant to state laws, and focusing on a recently filed lawsuit raising constitutional challenges to Colorado’s “force-pooling” law. Their article discusses the purposes of such laws, challenges to similar laws in other states, and the state of the Colorado challenge. Although their article focuses on Colorado, the authors note that it has “broader applicability to other oil and gas-producing states and, really, to any situation (e.g., dealing with groundwater) where separately owned property interests must be reconciled with the use of a common source of supply.” This issue may continue to arise around the United States as oil and gas development and urbanized residential and commercial areas continue creeping toward each other.
