Partner Prof. Dr. Bernd Geier from BCLP’s Frankfurt office authored an article published Feb. 1 by Börsen-Zeitung concerning new draft legislation aimed at financial investment brokers (Finanzanlagenvermittler). Due to the legislation proposal, brokers will be subjected to the supervision of the German Federal Financial Supervisory Authority (BaFin). With BaFin centralizing supervision, brokers may expect intensified scrutiny. Geier argues that the timeframe proposed by German lawmakers is very ambitious and it could lead to brokers looking out for new organizational structures to limit liability.
