London, Fitzgerald Author Article in ‘Law360’ on Colorado’s Regulation of Oil and Gas Development

Denver Associates Ivan London and Zach Fitzgerald authored an article published June 14 in Law360 explaining the impacts of a controversial new law in Colorado (S.B. 19-181) that will dramatically change the regulation of oil and gas development in the state. Among other things, the new law empowers local governments to regulate oil and gas development and fundamentally changes how state regulators must approach development. The article particularly dives into the new law’s requirements that two state agencies, the Colorado Oil and Gas Conservation Commission (COGCC) and the Colorado Air Quality Control Commission, must make new rules regulating oil and gas development, which will result in years of complicated rulemaking and public comment opportunities. London and Fitzgerald discuss some of the complicated issues that will come up during the rulemaking, and explain that “The COGCC has already begun this process. But this will take time—likely years. Hence, it looks like the ride in Colorado will keep going for the state’s oil and gas-development opponents and proponents for some time.”
