Miami Partner Pedro J. Martinez-Fraga published a Spanish language law review in the Spanish Journal of Public International Law of the University of Navarra in Pamplona, Spain. This journal only publishes peer-reviewed articles and has been consistently ranked as the leading academic journal in the field of public international law in Spain and among the top 10 in Europe. The article is particularly relevant because it purports to provide conceptual clarity to the issue of limitations periods governing claims based on public international law. Nothing has been written on the subject, which is in need of doctrinal development in part because only 132 of the approximately 3,000 bilateral and multilateral trade and investment treaties in force contain a limitations period. This deficit presents a number of practical and conceptual challenges that the article addresses and attempts to resolve using international and not domestic law paradigms that advance the policy objectives of both certainty and finality.
