BCLP Of Counsel Suzanne Berger is set to present on common commercial real estate foreclosure defenses and related concerns for the Practicing Law Institute’s 2024 Commercial Real Estate Financing program in New York and virtually on Tuesday, March 26, at 11:30 am ET.

During the hour session, titled "Common Foreclosure Defenses and Issues," Suzanne will cover:

  • Understanding the election of remedies and which states apply the “single action” rule;
  • Selecting or challenging jurisdiction and venue;
  • Learning about predicate notices and proper acceleration;
  • Assessing whether the plaintiff has standing;
  • Considering lender liability;
  • Comparing immaterial defaults;
  • Identifying missing necessary parties;
  • Understanding evidentiary issues for business records used by successor servicer;
  • Reviewing the New York Foreclosure Abuse and Prevention Act; and
  • Advising clients on New York deficiency judgments.
