Energy regulatory and enforcement lawyer strengthens BCLP’s Energy, Environment & Infrastructure Practice

International law firm BCLP today announced the addition of Counsel Maxwell K. Multer to the firm’s global Energy, Environment & Infrastructure Practice. Maxwell joins the firm’s Charlotte and Washington, DC offices.

Maxwell brings with him deep sector experience gained in prior positions at the Federal Energy Regulatory Commission (FERC) and in-house with a large public utility. He advises a diverse client base in energy policy and stakeholder matters, regulatory planning and compliance, and energy enforcement matters.

As an attorney working for one of the country’s largest combination utilities, Maxwell’s practice included a variety of federal and state regulatory matters, giving him valuable insight into the regulated utility business model, utility ratemaking and tariff design, and the practical interplay between federal and state regulation of energy. He gained particular knowledge of issues related to distributed generation and FERC Order No. 2222, transmission planning and cost allocation, and distribution and transmission level interconnections. These are all areas of significant, ongoing regulatory development.

During his time in FERC’s Office of Enforcement, Maxwell investigated and prosecuted a wide variety of potential violations of ISO/RTO tariffs, the prohibition on market manipulation, pipeline tariffs, NERC reliability standards, and FERC's rules, regulations, and orders. In addition to Maxwell’s foundational scholarship on open market manipulation, which has been cited by academics and courts all over the world, while at FERC he advised on market manipulation enforcement policy and worked on many of the first (Energy Transfer Partners and Amaranth Advisors), largest (Total Gas and Power, North America, Inc.), and most novel (GreenHat Energy LLC) market manipulation cases pursued by the Commission.
