Partner quoted in ‘Law360’ on Uber Security Chief conviction
May 19, 2023BCLP Partner Renato Mariotti was quoted May 17 by Law360 on the recent conviction of Uber’s security chief, Joseph Sullivan. Among the ideas former prosecutors expressed about why only Sullivan faced charges was that the U.S. Attorney's Office may have felt it had more direct evidence that Sullivan had arranged the payoff and hid the breach from the Federal Trade Commission, which was in the final stages of closing its probe into a similar breach the company suffered in 2014. A case against Travis Kalanick, the former CEO, likely would have included allegations that the Uber founder "conspired" to cover up the breach, a type of charge that is more challenging to prove than the obstruction and failure to report a felony charges that Sullivan was hit with, ex-prosecutors said. "There's a difference between what looks suspicious and what you can prove beyond a reasonable doubt," said Renato, a former federal prosecutor.
