Partners author article in ‘Law360’ on FCA case

Partners Andrey Spektor, Laura Perlov, and Anne Redcross Beehler authored an article published April 14 in Law360 that examined an important upcoming False Claim Act (FCA) argument before the Supreme Court. The consolidated appeals in U.S. v. SuperValu Inc. and U.S. v. Safeway Inc., the authors wrote, present the Court with the question of whether a “defendant can knowingly violate the FCA by incorrectly interpreting an ambiguous legal requirement in an objectively reasonable way.” The authors predicted the likely focus of the oral argument and the impact that a decision in this case will have for FCA litigation.
