Biography

Linda Hsu practices in the financial services disputes, class actions, product liability, and commercial litigation practice groups. She has experience litigating issues confronting small and large companies, including defense of companies against class, complex, and multidistrict claims in federal and state courts throughout the United States. Linda handles cases in all stages of litigation and represents businesses defending against putative consumer class action matters and other complex commercial litigation.

In addition, Linda has defended aircraft manufacturers, maintenance service providers, component part manufacturers, and aviation service companies in accidents and airport incidents. She has also defended aircraft, aerospace, insulation, chemical, and metal manufacturers in mass toxic-tort litigation involving asbestos, benzene, beryllium, diacetyl, and manganese exposure.

Linda has worked in-house at the headquarters of a social media technology services company. During her secondment, she served as interim general counsel and handled all legal issues, including development and implementation of the company’s terms of service and document retention policy.

Linda has been named as a “Rising Star” by Southern California Super Lawyers and is the Chair of the Santa Monica office’s Recruiting Committee. She was born in São Paulo, Brazil and is conversational in Portuguese and Spanish.

  • Represented an online dating service in putative California statewide class action asserting violation of state discrimination statutes and obtained order granting motion to dismiss for lack of personal jurisdiction.
  • Obtained favorable individual settlement for an online dating service in putative California statewide class action asserting claims for violation of state advertising statutes.
  • Represented global consumer retail banking institution and related defendants in California state and federal court litigation claiming consumer elder abuse in connection with alleged third-party fraud scams involving electronic funds transfers.
  • Represented global retail banking institution in putative class action alleging violation of COVID-19 mortgage modification and loss mitigation moratoria. Obtained dismissal of putative class claims and successful individual settlement.
  • Defended national mortgage lending entities and appraisal management company in multi-state putative class action alleging RICO conspiracy and RESPA violations in connection with home purchase finance and valuation.
  • Defended claims of negligence, premises liability, negligent misrepresentation and negligent infliction of emotional distress against nationwide financial institution arising out of claims that holdover tenant caused physical injury to eviction contractor by firing a shotgun during attempted eviction procedure.
  • Obtained favorable individual settlement for national mortgage lending entity in putative class action alleging improper payment accounting related to home purchase finance.
  • Represented manufacturer in multidistrict litigation arising from crash of Asiana Airlines Flight 214 at San Francisco International Airport.
  • Obtained favorable individual settlement for social media technology services company in putative California statewide class action asserting claims for violation of state disclosure statutes.
  • Advised social media technology services company regarding implementation of consumer arbitration provisions and class action waivers into terms of service.
  • Litigation work throughout the United States in defense of aircraft component manufacturers and maintenance service providers arising from aviation incidents and accidents.
  • Defense of aircraft and aircraft component manufacturers in federal and state courts throughout the United States against claims arising from alleged asbestos exposure.
  • Defense of product manufacturers in toxic-tort actions involving a variety of medical and scientific causation claims.
  • Defense of companies in breach of contract and other complex business disputes.
  • Defended helicopter manufacturer against claims arising from helicopter crash in Russia. Obtained order granting motion to dismiss the entire action based on forum non conveniens, as well as subsequent orders denying motions to reinstate the case after the foreign court rejected jurisdiction.
  • Participated in binding arbitration of personal injury lawsuit against airport service provider involving accident at Los Angeles International Airport.
