BCLP Blog Post on Prop. 65 Highlighted by ‘Inside EPA’
Aug 18, 2020A blog post jointly written by members of BCLP’s retail law blog and emerging contaminants blog was featured Aug. 13 by Inside EPA in an article examining proposed changes to California’s Proposition 65. California regulators are considering exceptions to Prop. 65’s warning label requirements for chemicals in food products – including acrylamide – that are formed during the cooking process. The state’s Office of Environmental Health Hazard Assessment (OEHHA) has set an Oct. 6 deadline for written comments on the proposal. BCLP’s blog post noted that the proposed regulation is expected to receive “significant public comments from all sides of the Prop. 65 community, so the form that it will take if and when it is ultimately adopted is very much up for debate.” Companies “should therefore consider revising their manufacturing processes to ensure that they are reducing the concentration to the lowest level feasible, or meeting the maximum concentration levels discussed above, but should be aware that both standards may change in the final version of the regulation.” The original BCLP blog post by San Francisco Partner Tom Lee, Counsel Merrit Jones and Associate Doug Alvarez can be found here or here.
