A Virginia state court granted BCLP’s renewed motion to dismiss all claims against Springfield—with prejudice.

The case stemmed from a personal injury lawsuit filed by Jason Allen, who sustained a gunshot wound to his leg while attempting to holster a firearm manufactured by our client, Springfield. Despite the allegations, a pre-suit inspection revealed that the weapon functioned properly, and there were no plausible allegations to support the plaintiff’s claim of product failure.

Springfield’s General Counsel, Dan Spencer noted: "This is truly an outstanding result, and I could not be more appreciative of the work the BCLP team put in to achieve it.  The result is a testament to BCLP’s deep knowledge of our business, our products, and the nuances of these cases. Please extend my thanks and congratulations to everyone on your team who contributed to this win."

BCLP Partner Randy Soriano led the defense, with excellent help from BCLP colleagues Peter Bay and Gabbie Byrne as well as working closely with Springfield’s General Counsel and in-house product expert, Dave Williams to bring about this fantastic result.
