Biography
R. Nelson Williams is a partner in the firm’s Employment & Labor Practice Group. He is a highly experienced attorney who represents employers in a broad range of employment law and litigation matters. Nelson’s client work spans several industries, including telecommunications, software, development, banking, and agriculture.
Nelson has defended numerous class and collective action matters under the FLSA and state law, including class litigation for both small and multinational companies, resulting in significant wins for his clients. One of his most notable victories resulted in the denial of Rule 23 class certification and the concurrent FLSA decertification of a collective action in a California wage and hour matter. Since that time, he has continued to add multiple class wins to his roster.
Nelson has successfully represented employers in matters involving the ADEA, ADA, FMLA, and Title VII. In each matter, Nelson takes an aggressive but thoughtful approach to employment litigation. He enjoys researching the specific needs of a client and developing a tailored litigation strategy that aligns with a client’s goals and helps them achieve the best possible outcome. Over the last several years, Nelson maintained an active docket that culminated with over 100 cases.
Nelson also has rare experience in litigating union grievances, having defended several employers across the United States in wrongful discharge and contract interpretation grievances.
Prior to joining BCLP, Nelson was a partner at Thompson Coburn LLP in St. Louis where he served as vice-chair of the Labor and Employment Practice Group and chair of the African-American Affinity Group. He is an active champion of diversity in the legal and business community, frequently mentoring diverse law students. Nelson also serves as chair of Momentum Advisory Collective, an organization that provides full wraparound care, education, and employment for justice-involved youth.

Experience
- Representing one of the world’s largest manufacturers of personal care products in two employment discrimination matters. In the first, defending against a pro se complaint alleging race, age, and national origin discrimination, retaliatory termination, and failure to promote. In the second, pending in the Southern District of Alabama, defending claims of race and gender discrimination, retaliation, failure to promote, and hostile work environment.
- Represented a financial institution in a number of employment matters over the years, including employment discrimination cases under the ADA and Title VII, as well as a class action case that the plaintiffs voluntarily dismissed.
- Defended over a dozen discharge and contract interpretation arbitrations for companies in the manufacturing, distribution, and agriculture industries. One discharge arbitration involved a 20+ year employee who was accused of making homophobic slurs, sexual harassment, and engaging in slowdowns. Another discharge arbitration involved a long-term employee who had been accused of stealing from the company. We also advised a client on a contract interpretation involving the Company’s discretion to award positions based on skills, knowledge, ability, training, and experience versus seniority.
- Defended a telecommunications company in a nationwide FLSA collective action and multi-state Rule 23 class action in the Eastern District of Missouri. The plaintiffs were call center agents who alleged they were performed pre-shift and post-shift work for which they were not paid, resulting in unpaid overtime. We obtained decertification of the collective action and denial of Rule 23 class certification. The plaintiffs ultimately voluntarily dismissed the case for $0.
- Successfully defended a software and services company in a California FLSA collective action and Rule 23 class action in which the plaintiffs claimed they were misclassified as exempt. The case resulted in decertification of the collective action and denial of class certification.
- Successfully defended a construction engineering company in a class action in California state court, in which the plaintiffs claimed they were misclassified as independent contractors. The court denied class certification, and that decision was upheld on appeal.
