BCLP counsels clients at the intersection of law, policy, and enforcement, where state attorneys general (AGs) and other state regulators increasingly shape the regulatory landscape. We advise on privacy and data‑protection matters, competition investigations and litigation, consumer protection issues and litigation, and complex multijurisdictional regulatory issues. We also have experience in matters where there are parallel civil or criminal actions by federal regulators or private litigants. Our team includes multiple former state officials and former federal officials who worked closely with state counterparts, giving us deep insight into how AG offices operate and what drives their priorities. With strong relationships across state agencies nationwide and a government‑side perspective, we provide practical, strategic guidance to help clients navigate sensitive matters efficiently and effectively.

- Advise clients in privacy and data‑protection matters involving the California, New York, and Indiana AGs, including responses to enforcement inquiries and negotiation of compliant remediation strategies.
- Defend the NCAA in a multistate action led by the Ohio AG challenging transfer‑eligibility rules for student‑athletes, achieving a favorable, multi‑state settlement with a dozen states and the U.S. Department of Justice.
- Guide a foreign‑based client through a self‑report to the New York AG’s Investor Protection Bureau under the Martin Act, cooperate throughout the investigation, and secure a favorable Assurance of Discontinuance resolving the matter without further enforcement.
- Represent a client in a multi‑year matter involving investigatory and litigation activity by the Oklahoma AG’s Office, the Governor’s Office, and other state and federal authorities, including securing a dismissal in federal court.
- Represent a critical third party in a multistate investigation led by 12 AGs examining alleged coordination of competitive terms by manufacturers through distributor‑based restrictions.
- Successfully defend a pharmaceutical company in joint state AG–FTC litigation alleging anticompetitive conduct intended to preserve the exclusivity of a patented drug.
- Defend a merger under investigation by the Department of Justice and a coalition of seven state AGs, advising on strategy, advocacy, and compliance throughout the review process.
- Achieve a successful resolution of a state AG inquiry into a transportation‑sector joint venture, involving a concentrated industry and state government contracting issues, with no adverse findings or remedies imposed.
- Serve as a Deputy Attorney General for the State of Alabama, acting as special counsel to the Alabama Credit Union Association on complex regulatory and enforcement matters involving one of the state’s largest financial institutions.
- Represent hotel franchising company in a state AG investigation into whether the company has structured and administers its price guarantee program in a way that misleads consumers.
- Assist clients aggrieved by anticompetitive conduct in alerting state antitrust AGs about the clients' concerns.
- Regularly defend merger investigations brought by states, both in connection with the federal premerger review process, as well as state-specific merger reviews.
