Attorneys Author Article in Bar Association’s ‘Trial Briefs’ on Biometrics and Business Re-Openings

Chicago Associates Lauren Caisman and Patrick DePoy authored an article in the December edition of the Illinois State Bar Association’s newsletter Trial Briefs concerning class-action lawsuits filed under the Illinois Biometric Information Privacy Act (BIPA), which regulates the retention, collection, disclosure and destruction of “biometric identifiers” and “biometric information.” Any business owner who uses one of various temperature screening methods as part of their COVID-19 reopening plan should do so with the BIPA in mind. “Anyone looking to implement thermal imaging technology must thus have a thorough understanding of the technology selected – and the data it captures and security protections in place – before rolling out temperature screenings on a widespread basis,” they wrote. “Selecting a technology that collects the least amount of data necessary to accomplish the given task is recommended.”
