BCLP Lawyer in ‘Law360’ on Senate Confirming Two NLRB Picks, Teeing Up Dem Majority

BCLP Senior Counsel Jerry M. Hunter was quoted July 28 by Law360 concerning the Senate confirmation of two union lawyers nominated by President Biden to serve as members of the National Labor Relations Board (NLRB), solidifying the Democratic majority at the federal labor agency for the first time since 2017. Lawmakers voted to confirm Gwynne Wilcox to fill one current vacancy on the board and confirmed David Prouty to fill another seat that will become vacant when member Bill Emanuel's term ends in August. Hunter told Law360 that Prouty's confirmation was unusual because the seat he's set to fill isn't currently vacant. "I don't know if the Senate has ever confirmed someone for a board seat where they confirm a replacement board member even before the term of the current board member expires," Hunter said. "That's just so unusual. Emanuel has another month in the job." Hunter is a former NLRB general counsel, having served during the administration of former President George H.W. Bush.
