BCLP Partner Julie Catala Marty participated in the panel “Competition compliance programs: evolution or revolution?” as part of the « Débats » organized by the Lettre des juristes d'affaires (LJA).

This was an opportunity to discuss a crucial issue for companies and to review the approach of the French Competition Authority (Autorité de la Concurrence) in this area. Thus, for Julie Catala Marty, "The new framework document confirms the "ni-ni" approach: the implementation of a compliance program cannot give rise to a reduction in the penalty, [nor] can it give rise [...] to an increase in the penalty when the program fails. The removal of the financial incentive to implement a compliance program amounts to imposing a kind of obligation of result on companies".
