BCLP Partner Catherine Turner was quoted June 21 in HR Magazine on a landmark tribunal that allowed former employee Terrance Burke to successfully claim that long Covid should be classed as a disability. Catherine noted that the ruling should make employers think about how they deal with long Covid cases. "Employers should note this decision and consider carefully any steps taken in respect of employees who are off sick because of long Covid or what could be long Covid." Catherine suggested that Burke's case was aided by his inability to attend face-to-face GP appointments, meaning the tribunal therefore was willing to accept less evidence. “Medical evidence is key in disability claims and the onus is on the individual bringing the claim to prove disability," she said.
