Partner Christian Auty, co-leader of BCLP’s US Data Privacy & Security Team, was quoted July 26 by SC Magazine on the pitfalls of responding too quickly to a data breach. While a quick response might feel like the best way to clear your business’ reputation, it’s best to know all the facts first. “If you’re stating, ‘We weren’t compromised, those aren’t our documents’ and then it turns out that those are your documents, and you have been compromised, that doesn’t look good to a regulator,” Auty said. Be prepared for investigations to take time, he cautioned, as establishing that something did not happen is difficult.
