Hunter in ‘Law360,’ Bloomberg Law on NLRB Challenge to Judge’s Order on Union Election Rule

St. Louis Partner Jerry Hunter was quoted June 1 by Law360 and Bloomberg Law's Daily Labor Report concerning the National Labor Relations Board’s (NLRB) statement that it will challenge a Washington, D.C., federal judge's recent order blocking parts of a rule that slows down the union representation election process. The board said it will immediately implement portions of the regulation that were untouched by the order. Hunter said it behooves the NLRB to pursue a "limited" regulation that addresses the parts of the rule that Judge Jackson struck down instead of going ahead with an appeals process that could take far longer. "By going ahead and implementing all of the provisions which the district court did not invalidate, the NLRB only has to appeal a limited number of provisions which the court invalidated or the NLRB can move forward and conduct a limited rulemaking on the provisions contained in the rule which the court invalidated," said Hunter, a former NLRB general counsel.
