Hunter in ‘Law360’ and Bloomberg Law on Biden’s Decision to Fire NLRB GC Robb

St. Louis Senior Counsel Jerry M. Hunter was quoted Jan. 20 by Law360 and Jan. 21 by Bloomberg Law concerning Biden’s decision to fire National Labor Relations Board (NLRB) General Counsel Peter Robb after he declined to resign. Hunter questioned whether Biden has the power to remove Robb. “He has no obligation to resign, and I don't know what the procedure is [to fire him] since it's never been done before,” said Hunter, who is a former NLRB general counsel, having served during the administration of former President George H.W. Bush. Hunter told Bloomberg Law that despite some non-binding authority backing Biden’s power to fire Robb, serious questions remain about whether a court will decide he could. “This could be another Noel Canning situation,” Hunter said, referring to one of the Supreme Court’s decisions that went against NLRB appointees.
