Hunter in ‘Law360’ on NLRB Acting Prosecutor Scrapping Challenge to Neutrality Pact
Feb 09, 2021St. Louis Senior Counsel Jerry M. Hunter was quoted Jan. 29 by Law360 concerning the National Labor Relations Board’s (NLRB) acting General Counsel Peter Sung Ohr, who recently dropped a case his predecessor brought challenging “neutrality agreements” between employers and unions. Hunter said the decision to reverse course on the complaint was unusual, especially given the short time Ohr has been on the job and the distance general counsel typically have from the day-to-day prosecution of such cases. "That decision was made with unusual speed," said Hunter, who is a former NLRB general counsel, having served during the administration of former President George H.W. Bush. Hunter also said, “the sudden reversal, coupled with Biden's move to fire Robb, "undercuts the neutrality" of the NLRB and jeopardizes how the public views the agency.”
