BCLP Senior Associate Nadia Hubbuck and Knowledge Counsel Victoria Clark have co-authored two articles on the impact of sanctions on arbitration which have been published in Practical Law Arbitration.

Impact of Sanctions on Drafting Arbitration Clauses

The first article considers the impact of sanctions on substantive and procedural issues in international arbitration proceedings.  It highlights key issues parties should consider when drafting arbitration clauses to minimise the impact of sanctions.

Sanctions and Arbitration: Impact of Amendments to Russian Arbitrazh Procedure Code

The second article considers amendments to the Russian Arbitrazh Procedure Code made in 2020, and their effect on the enforceability of arbitration agreements involving sanctioned parties in the light of recent Russian court decisions.

Nadia is a specialist in the impact of sanctions on arbitration clauses and speaks regularly on this topic.  She is the author of “The Effect of Exclusive Jurisdiction of Russian State Courts over Sanctioned Persons on International Arbitration Proceedings” published in the March 2024 Special Issue of The Journal of Transnational Dispute Management on Sanctions and International Arbitration.
