Jerry Hunter, a senior counsel in BCLP's Employment and Labor practice, recently discussed National Labor Relations Board (NLRB) ethics in relation to NLRB general counsel Crystal Carey with Law360.

In the article, Jerry discussed the one-year recusal period in the ethics agreement and suggested possible steps Carey may take over potential conflicts of interest given questions surrounding former member William Emanuel that dogged the first Trump board. 

"Clearly it's an indication to me that the U.S. Code and regulations were written in such a way to provide that individuals appointed … can decide cases and that they're not subject to a lifetime banishment or exile or otherwise have a scarlet letter that would preclude them from deciding cases," Jerry told Law360.

Jerry was general counsel of the National Labor Relations Board (NLRB) in Washington, D.C., from 1989 until 1993. His practice involves representing management in all phases of labor and employment law, including preventive labor relations and supervisory training, labor arbitrations, handling charges filed with the NLRB, the Equal Employment Opportunity Commission, U.S. Department of Labor, state and local civil rights agencies and cases filed in federal and state courts.
