Lawyers featured in ‘Thomson Reuters’ on first ever trucks cartel litigation trial in UK

BCLP Partners Edward Coulson and Ben Blacklock, and Senior Associate Alexandra Hildyard, authored an article published Mar. 2 in Thomson Reuters Practical Law concerning a recent ruling by the Competition Appeal Tribunal (CAT) in the first ever trucks cartel litigation to go to trial in the UK. The CAT ruled that a cartel of truck manufacturers led to a material overcharge on a UK market-wide basis (Royal Mail v DAF and BT v DAF [2023] CAT 6), with the decision expected to have a significant influence on numerous other claims in relation to the cartel across Europe. In the article, the authors explain various aspects of the dispute and ruling including plausibility, causation, overcharge, cost of financing, pass on and other forms of mitigation.
