BCLP Partner Philippe Métais was interviewed April 19 on BFM TV concerning the liabilities of companies involved in food scandals in France, and after the recall of several products from the market. Each company is responsible for the products it places on the market. Depending on the sector of activity, control procedures exist and companies must comply with their sectoral obligations. If, despite everything, a product proves to be deficient, the company must recall it and withdraw it from sale. It has to notify the administration, the distributors and the consumers. Depending on the situation, there are several options. If it turns out that the company did not respect its obligations, the company can be prosecuted. Both the company and the director could be criminally responsible.
