Sacher in ‘The Insurer’ on South African Court Ruling regarding UK COVID-19 BI dispute

London Partner Jonathan Sacher was quoted July 10 by The Insurer regarding a South African court ruling against an insurer and with a small business owner in one of the first tests relating to COVID-19 causation and liability under Common Law principles, using UK insurance wordings.

Sacher, who is a co-leader of BCLP’s Insurance Sector, said “The judgment, whilst not authoritative in the context of the forthcoming FCA test case, nevertheless gives an interesting insight as to how a UK Court may need to consider tricky issues of causation and the meaning of certain ‘trigger’ wordings that are common in the UK property/BI insurance market.”
