Smith in ‘ABA Journal’ on Supreme Court’s Upcoming Remote Hearings

St. Louis Partner Barbara Smith was quoted April 21 in the ABA Journal concerning plans by the Supreme Court of the United States to hear telephone arguments for the first time. There were approximately 20 cases scheduled for argument in March and April that initially were postponed indefinitely. Of those, the court chose 10 to hear in a two-week session that begins May 4, with the others put off until next term. Among the cases that will be argued, one involves access to President Donald Trump’s financial records and two involve how members of the Electoral College may cast their votes. “I wish I could be a fly on the wall to understand why the court chose the cases it decided to hear in May,” said Smith, a former law clerk to Justice Samuel A. Alito Jr. “For the law clerks, it certainly seems to be an historic time to be behind the scenes.”
