Biography
Ben is a first chair litigator with extensive trial and appellate experience who helps clients solve their most difficult legal problems. He has tried cases to juries in federal and state courts and has presented oral argument in numerous appeals in the Fourth, Ninth, and Eleventh Circuits and various state appellate courts, often securing precedent-setting victories across practice areas. Ben has also authored briefs in other federal courts of appeal, including petition- and merits-stage briefing in the U.S. Supreme Court. Recognized for his strong written and oral advocacy, Ben fights for his clients from trial through appeal.
Ben is a member of the firm’s Appellate and Supreme Court Group and the Business & Commercial Disputes Practice Group. His nationwide litigation practice focuses on business litigation and regulatory compliance. His representations have involved nationwide class actions, products liability, trade secrets, intellectual property, and regulatory compliance issues. Ben also has an active pro bono practice. He has helped undo wrongful convictions with the Innocence Project, has worked on death penalty cases, and has represented farmers and ranchers on appeal to vindicate their infringed water rights.
In addition to his litigation practice, Ben also serves as a trusted business advisor and helps clients identify and address legal needs. He has experience advising startup companies on corporate governance and capital raising efforts. He also advises on compliance issues and assists with negotiating, drafting, and analyzing various types of corporate agreements.
Prior to joining BCLP, Ben clerked for the Honorable Robert B. King on the U.S. Court of Appeals for the Fourth Circuit and then practiced as a litigation associate at a nationwide firm. While in law school, Ben served as Editor-in-Chief of the West Virginia Law Review, President of the Fund for Law in the Public Interest, and a member of the Supreme Court Clinic, where he represented indigent clients on appeal.
Ben has been recognized for years by Super Lawyers as a “Rising Star” and by Best Lawyers as “One to Watch.”
