Biography

Gioconda (Jackie) Iannicelli has represented management in all areas of employment law for more than 20 years, including handling discrimination, retaliation, breach of contract, wage and hour and defamation cases in 20 different states. Ms. Iannicelli has substantial trial experience in both state and federal courts and has successfully argued before state and federal appellate courts.

Ms. Iannicelli routinely advises human resources managers and in-house counsel regarding hiring, firing and discipline decisions, internal investigations, and leave of absence and wage and hour issues.

In addition, Ms. Iannicelli has authored and presented numerous seminars and training modules relating to various areas of employment law, including discrimination, harassment, retaliation, and leave of absence and wage and hour issues.  Ms. Iannicelli has been a guest lecturer at educational institutions and has co-authored several employment law newsletters and handbooks.

  • Ware v. Jewel Food Stores (U.S.D.C. for the Northern District of Illinois) - Won summary judgment on claims of disability discrimination (discharge) and failure to accommodate
  • Crawford v. Security First Group (U.S.D.C. for the Southern District of Iowa) – Won jury trial. Jury returned defense verdict on Plaintiff’s claims (e.g., defamation, breach of contract, etc.) and found in defendant’s favor on its counterclaims (e.g., fraudulent misrepresentation)
  • Bickerstaff v. Nordstrom (U.S.D.C. for the Northern District of Illinois) – Won summary judgment on Plaintiff’s race discrimination claims (failure to promote and constructive discharge)
  • Fizzell v. Robert Bosch Corporation (U.S.D.C. for the Western District of Michigan) – Obtained dismissal of claim under Supplemental Unemployment Benefits Act, and the imposition of sanctions against Plaintiff’s counsel
  • Whittier v. Metropolitan Life Insurance Company (U.S. Court of Appeals for the Sixth Circuit) – Court of Appeals upheld favorable arbitration award
