Biography

Ken is a business trial lawyer.  For over 35 years, he has represented clients in complex business, commercial, class action, products liability, non-compete/trade secret and intellectual property matters.  He has appeared in federal and state courts across the country, including many of the well known "judicial hell holes."  In addition, he has appeared before numerous arbitrators and mediators.

Experience

    • Complex Commercial – Tried and won dispute involving a closely held company in which the minority shareholder was frozen out by the majority shareholder. Tried and won an arbitration in which a food manufacturer complained that a food colorant was defective and should be removed from the marketplace. Tried and won an appeal from the Missouri Supreme Court on a put option agreement for shares of a company.  Over the years, represented clients in cases involving breach of contract, warranty, UCC, fraud, RICO, federal and state consumer protection statutes and antitrust claims
    • Class Actions – Tried and won a nationwide class action against an automobile manufacturer from whom plaintiffs sought over $2 billion in damages. Won the dismissal of a class action against a federal thrift based on pre-emption grounds. Over the years, represented clients in class actions involving financial services, telecommunications, industrial gases, lead, tobacco, publishing, consumer goods, commercial products, toys, and computer software and hardware
    • Products Liability – Represented clients in strict liability, negligence and related actions involving machine equipment, chemical equipment, power tools, plumbing supplies, automobiles and other consumer goods. Secured a settlement for an industrial gas manufacturer after an explosion at one of its plants. He also tried and won "hot coffee" cases against a national restaurant chain
    • Non-Compete/Trade Secrets and Intellectual Property – Represented employers and employees in non-compete/trade secret cases across the country. Represented clients in patent and trademark cases including claims of infringement, lost profits and reasonable royalties, willful infringement and the award of pre-judgment interest
