Overview

BCLP has a dedicated team addressing the rapidly evolving issues concerning air emissions of ethylene oxide (EtO) from various facilities. 

EtO is a colourless, reactive gas at room temperature. It is a chemical intermediate in the production of ethylene glycol and other chemicals.  It is used in many manufacturing industries.  It is often used to sterilize products.  

The International Agency for Research on Cancer (“IARC”) considers EtO carcinogenic in humans.  USEPA’s National Air Toxics Assessment recently identified areas in the United States where ETO emissions are above risk based standards.  This new information has led to regulatory investigations, regulatory enforcement, plant closures (one known case) and toxic tort litigation.  

BCLP attorneys have been involved in EtO litigation and understand the science and the issues concerning the chemical.

Our team is assisting clients in navigating the regulatory, enforcement, risk management, compliance and litigation issues concerning EtO and other chemicals. 

The team includes:

  • Erin Brooks, an environmental attorney with a nationwide practice in real estate redevelopment and renewable energy.
  • Dale Guariglia, an attorney practicing exclusively in the areas of environmental and occupational safety law.
