Biography

Anne-Elisabeth est collaboratrice senior au sein de l’équipe Concurrence et Distribution, basée à Paris.

Anne-Elisabeth conseille les entreprises sur des problématiques de droit de la concurrence, notamment dans le cadre d’enquêtes et de procédures menées devant l’Autorité de la concurrence française et la Commission européenne (ententes horizontales/cartels, ententes verticales), ainsi qu’en matière de contrôle des concentrations et d’aides d’État.

Anne-Elisabeth accompagne également les clients dans le cadre du contrôle des concentrations et des marchés publics prévus par le règlement sur les subventions étrangères.

Anne-Elisabeth intervient dans plusieurs secteurs, tels que les produits de grande consommation, l’énergie et le secteur bancaire.

Anne-Elisabeth est titulaire d’un LLM en droit de la concurrence obtenu à King’s College London, ainsi que d’un LLM en droit des affaires européen et comparé de l’Université Humboldt de Berlin. Elle a obtenu sa licence à Paris Panthéon-Assas.

Foreign Subsidy Control : Summary of recent Developments

Over the past few months, a first draft of guidelines on the implementation of the regulation on foreign subsidies has been published. Perhaps more significantly, a review of the regulation itself has been launched — just two years after it came into force. Below is a summary of the main developments. Regulation 2022/2560 on foreign subsidies distorting the internal market (FSR), which came into force on July 12, 2023, aims to remedy the distortions caused by subsidies paid by third countries to companies in the European Union. Since October 12, 2023, the European Commission has been responsible for monitoring mergers and public procurement procedures involving companies that have received foreign financial support. It has several tools at its disposal to do this: mandatory notification of mergers and responses to public procurement contracts exceeding certain thresholds, the possibility of conducting investigations on its own initiative, and the imposition of corrective measures in the event of identified distortions of competition.
