Artificial intelligence is changing all aspects of life and attorneys must learn about AI to assist their clients with sweeping fast-paced changes in technology. OpenAI's ChatGPT and other generative AI tools are a significant advance over previous forms of AI. These tools are becoming more popular each day, and most organizations are excited and curious about the potential of the latest forms of this technology. However, there are a myriad of risks and novel issues associated with the use of generative AI that must be considered.

While generative AI is opening new doors for organizations with time-saving tools, the technology has limitations that could cause big problems if left unchecked. The limitations typically center around the accuracy of its output and the data used to train its systems. Simple errors with the technology can put organizations at risk. Nonetheless, risks go far beyond reliability of generative AI.

Given the limitations of generative AI and the pace of its popularity, organizations need to take action now and be proactive by putting policies in place to ensure sound decisions are being made about its use. Having sound policies in place allows businesses to embrace this new technology, but also not go about it blindly, all while mitigating legal risks.

Some key areas a generative AI policy should cover are reliability; compliance; data confidentiality, privacy, and security; bias and discrimination; transparency and explainability; intellectual property infringement; employee training; management, accountability, and responsibility; ethical considerations; and continuous monitoring and improvement.

The panel will examine the growing use of ChatGPT and other generative AI in various business settings. The panel will address the need for organizations to put adequate policies and procedures in place to identify and manage the risks of this evolving technology.
