David B. Schwartz discusses NYC city-run grocery store antitrust lawsuit with Bloomberg Law
Sep 25, 2026David B. Schwartz, a partner in BCLP's Antitrust, Competition and Trade practice, recently spoke with Bloomberg Law about an antitrust lawsuit challenging New York Mayor Zohran Mamdani's plan to open city-run grocery stores.
In the article, David discusses the complaint and the hurdles of predatory pricing claims. He noted that predatory pricing is one of the hardest types of claims to win in court.
“There’s decades of Supreme Court law saying, ‘We don’t want courts to be in the business of deciding when cutting prices is bad or good,’" David told Bloomberg Law. "It all looks a lot like competition on the merits, which is what antitrust laws are designed to create."
