Partner Justin Winerman and Associate Sophie Berte, both in BCLP's Finance Transactions practice, discussed a recent Southern District of New York bankruptcy court opinion in an article published in Reuters and Westlaw.

In the article, Justin and Sophie examine the opinion, which demonstrates the use of emergency provisional relief under Chapter 15 to seek discovery prior to formal recognition of proceedings. They discuss the flexibility of Chapter 15, analyze the Chapter 15 filing and more.

"The opinion is another in a long line of cases showing how Chapter 15 can combine with other non-U.S. insolvency regimes to provide international companies with a wide range of tools that can be used to maximize value across the globe," they wrote.
