Justin Winerman, a partner in BCLP's Finance Transactions practice, recently discussed nonconsensual third-party releases and Chapter 15's distinct framework in an article published in Reuters and Westlaw.

In the article, Justin analyzes how notwithstanding the Supreme Court's decision in Harrington v. Purdue Pharma LP, which effectively closed the door on nonconsensual third party releases under a chapter 11 plan, those releases remain available under Chapter 15. As a result, multinational companies should carefully evaluate their options.

Justin has distinguished himself in cross-border matters, serving as lead counsel in a number of chapter 15 cases, obtaining recognition and enforcement of proceedings in multiple jurisdictions around the globe. He represents clients around the world in all aspects of complex corporate restructurings both in and out of court and across a wide range of industries, including health care, financial services, energy and media.
