Biography
Alex Whitworth, who serves as co-leader of the firm's Consumer Fraud team, has broad experience representing corporations and individuals in all stages of civil disputes from pre-litigation demand letters through trial and appeal. Her practice focuses primarily on complex consumer disputes and intellectual property litigation. She has represented clients in numerous industries, with an emphasis in consumer products, cryptocurrency, financial services, and technology. Clients appreciate her straight-forward and open communication style, pragmatic advice, and track-record of success. The favorable results she has obtained over the years are numerous.
In her consumer disputes practice, Alex has defended financial institutions and other corporate clients in some of their most high-stakes matters, often involving complex statutory schemes or extremely high-value tort claims.. In addition to working on complex class actions and multi-district litigations, she also assists clients manage strategy around high-volume single-plaintiff litigation and arbitrations.
Alex also has significant experience representing both plaintiffs and defendants in IP disputes, primarily related to trademark, trade dress, unfair competition, and false advertising claims. Alex obtained a unanimous jury verdict for AirWair International Ltd., the maker of Dr. Martens footwear, in a case alleging trade dress infringement against ITX, the U.S. subsidiary of fast-fashion giant Inditex.
Prior to joining BCLP, Alex worked at a large law firm in New York City and served as a law clerk for the Honorable Jay P. Cohen of the Florida Fifth District Court of Appeal. While clerking, she was also an adjunct faculty member at the Barry University School of Law, where she taught advanced appellate writing. Alex graduated with honors from the University of California, Santa Barbara and the Duke University School of Law. While in law school, she served as an editor for the Duke Law Journal and the Duke Forum for Law and Social Change.

Experience
- Lead appellate preservation/legal issues counsel in several multi-week product liability trials. Assisted in eliminating over $2 billion in punitive damages via post-trial motions and appeals.
- Lead counsel for Coinbase, Inc. in arbitrations alleging novel theory that Coinbase acted in violation of the federal securities laws. Prevailed on every claim, with arbitration awards subsequently confirmed in federal court.
- Second-chaired jury trial in trade dress infringement case; obtained jury verdict in favor of our client AirWair International Ltd., the maker of Dr. Martens footwear.
- Defended generic baby shampoo manufacturer against claims of trade dress infringement. Case settled favorably.
- Lead team of attorneys defending cryptocurrency exchange in multiple cases relating to allegedly hacked customer accounts. Our team has obtained numerous arbitration victories on the merits in AAA.
- Represented various national banks and loan servicers in numerous cases, including putative class actions, involving consumer protection statutes such as the FCRA, CLRA, UCL, EFTA, and TCPA, among others.
