Biography

Clients rely on Jacob Maskovich to navigate them through their difficult legal issues due to his versatility, commercial awareness, and responsiveness. He is a commercial litigator with two decades of courtroom experience. 

Drawing upon his deep experience resolving complex commercial litigation disputes, clients also frequently call Jacob to assist them with negotiating and documenting their most sophisticated and important commercial transactions, including significant supply and sale agreements.  

Jacob represents financial institutions, loan servicers, and other secured and unsecured creditors in debt enforcement actions, loan workout negotiations, defending claims of lender liability, and pursuing fraudulent transfer claims. He has particular experience using receivership, attachment, writs of garnishment, and other pre-judgment provisional remedies to maximize the ultimate recovery for his clients.

Jacob is skilled in all aspects of real estate litigation, leasing transactions, and construction law matters, including representing contractors and property owners in construction defect litigation, resolving mechanic’s and materialmen’s lien disputes, representing landlords and tenants in commercial real estate disputes and transactions, and handling real estate development disputes.

Jacob also regularly handles fiduciary litigation involving shareholders as well as trusts and estates at both the trial and appellate levels.

Experience

  • Representation of lender in coordinated receivership litigation occurring in six different jurisdictions and involving 15 different projects securing a $400 million loan portfolio.
  • Successfully defend the majority members of a limited liability company against breach of fiduciary duty and “shareholder oppression” claims brought by the minority members.
  • Obtained summary judgment in favor of a national lender on claims of lender liability where the borrower sought more than $20 million in damages.
  • Defended subcontractor in construction defect litigation arising from work in a residential master planned community.
  • Trial and appellate counsel for trustees successfully obtaining dismissal of beneficiaries' petition to remove trustees and asserting claims of breach of fiduciary duty.
  • Assist international commercial tenant in the re-negotiation of lease agreements covering more than a dozen locations.
  • Advise international equipment manufacturer in the negotiation and documentation of a purchase and sale agreement covering more than $500 million in sophisticated production equipment.
