Biography

Jarret P. Hitchings is a member of the firm’s Corporate and Finance Transactions Department, with experience in restructuring, insolvency and special situations. In particular, Jarret’s practice focuses on distressed asset litigation, including federal bankruptcy and state court liquidation proceedings. Jarret is active in matters across the country and internationally on behalf of debtors, creditors, fiduciaries, and foreign representatives in the United States. He has significant experience practicing in the country’s principal business courts including the United States Bankruptcy Courts for the District of Delaware, Southern District of New York and the Southern District of Texas, as well as Delaware’s Court of Chancery.

Jarret graduated magna cum laude from Villanova University School of Law, where he was elected to the Order of the Coif, and the Pennsylvania State University. Prior to joining the firm, Jarret was a litigation and restructuring partner in the Delaware office of another large international law firm. He is a member of the INSOL International and a member of Class X of the International Insolvency Institute’s NextGen Leadership Program. Since 2016, he has authored, either individually or as a co-author, numerous articles that have been published in The Legal Intelligencer, Law360, ABI Journal, Delaware Business Court Insider and INSOL World.

  • Lead bankruptcy litigation counsel to US subsidiaries of multinational industrial engineering and construction firm in their chapter 11 cases, achieving approval of significant asset sales in support of global divestment. 
  • Lead US counsel to assignee in an assignment-for-the-benefit-of-creditors (ABC) of Irish e-learning enterprise, winning approval of successful sale transaction and managing related litigation before the Delaware Chancery Court.
  • Delaware counsel to a commercial creditor of an insolvent reinsurance carrier with respect to the carrier’s state-ordered receivership pending before the Delaware Chancery Court.
  • Lead litigation counsel for financial institution with respect to successful defence of federal lending and collection practices actions in federal and state forums.
  • Litigation counsel to Spanish pharmaceutical company in fiduciary duty and books-and-records litigation against American portfolio company in the Delaware Chancery Court.
  • Litigation counsel to secured lender and special loan servicer in connection with state law commercial loan default and foreclosure litigation before the Delaware Superior Court.
  • Bankruptcy litigation counsel to secured lender in connection with the chapter 11 litigation, reorganization and refinancing of significant theme-park area hotel property.
  • Lead US bankruptcy counsel to the foreign representatives and joint administrators of a Guernsey holding company in connection with chapter 15 recognition proceedings in the United States.
  • US bankruptcy counsel to the foreign representatives and joint official liquidators for Cayman Island hedge fund in connection with the case administration and wind-down of chapter 15 cases for feeder-fund affiliates.
  • Bankruptcy litigation counsel to energy logistics company in connection with the multi-million dollar claims litigation against exploration and production company during its chapter 11 reorganization.
