Biography

Justin Benson practices complex litigation, with a particular focus on representing and defending corporations and individuals who do business with, or are regulated by, the federal government. He represents government contractors in bid protests before the U.S. Court of Federal Claims and the Government Accountability Office (GAO), as well as in litigation involving trade secrets, contractual performance, and consumer claims. Justin has extensive experience with federal investigations and prosecutions related to government contract performance and private sector participation in government programs. He has notable experience in helping clients respond to False Claims Act investigations. He also advises government contractors on compliance obligations, mandatory disclosures, responses to potential terminations for convenience, and subcontractor negotiations.

Clients consistently turn to Justin for their most pressing litigation needs in complex trial and appellate matters in federal and state courts nationwide. He has broad experience representing commercial clients from many different industries across all stages of litigation, including discovery, motion practice, trial, settlement negotiations, and appeals. Justin routinely argues dispositive motions in courts across the country and has successfully litigated Daubert and summary judgment motions in some of the most challenging jurisdictions. Justin has been recognized in the 2022 and 2025 editions of Best Lawyers: Ones to Watch for his work in commercial litigation.

Prior to joining BCLP, Justin was an associate at Sidley Austin LLP and served as a law clerk to the Honorable Carolyn Dineen King of the U.S. Court of Appeals for the Fifth Circuit. He also served as a legislative aide to a member of the U.S. House of Representatives.

Justin maintains an active pro bono practice. He has successfully represented an asylum seeker in Immigration Court and regularly represents tenants in D.C. Superior Court. He has also authored numerous amicus briefs on behalf of civil rights organizations in the federal appellate courts.

On January 21, 2025, the Trump Administration issued an executive order entitled “Ending Illegal Discrimination and Restoring Merit Based Opportunity” (“EO”). The stated purpose of the EO is to direct the federal government to enforce the civil rights laws by taking action against “illegal” preferences and discrimination, including measures taking aim at private sector diversity, equity, and inclusion (“DEI”) policies and programs. As we highlighted, the EO has significant implications for federal contractor affirmative action obligations and serves as a strong signal of the Trump administration’s increased scrutiny toward private sector DEI programs. Importantly, the EO also seeks to impose False Claims Act liability on federal contractors and grant recipients who maintain DEI programs that run afoul of federal civil rights law.
