Biography

Rachel is an associate in BCLP's market-leading Real Estates Disputes team (ranked in Band 1 by Chambers UK and in Tier 1 by Legal 500), advising on high-value property litigation and mitigating risk on complex development projects including residential service charge disputes, landlord and tenant disputes, issues and disputes concerning the Building Safety Act, rights of light and vacant possession strategies for clients in the real estate sector. 

Rachel has experience advising clients in the Court of Appeal, the High Court (including the Commercial Court and the Technology and Construction Court), the Upper Tribunal (Lands Chamber), and the First-tier Tribunal (Property Chamber).

Rachel regularly advises clients on asset management matters, including vacant possession strategies, the Landlord and Tenant Act 1954 and dilapidations.

She advises the full spectrum of real estate sector clients, including investors, developers, landlords and institutional tenants, on a range of property disputes affecting both commercial and residential property.

Rachel has worked on several pro bono projects at BCLP and is part of BCLP's Pro Bono team advising at a free legal advice clinic, which focuses on housing issues.

Experience

  • Acting for a client in the Technology and Commercial Court in a dispute that raises the question of which circumstances are required for a lease to be frustrated.
  • Advised a major property development and investment company in relation to its vacant possession strategy following its multi-million pound acquisition of an estate of properties in Soho, London, which included trespass-related work and possession proceedings. 
  • Acted for the landlord of a central London residential development applying for a determination that the cost of substantial works are payable as service charge.
  • Advised clients on residential and commercial possession proceedings, including successfully forfeiting a lease on a central London gallery, handling possession matters for high-end residential property, and securing vacant possession through trespass proceedings.
